Who is responsible

The data controller is [[TO FILL: legal name]], [[TO FILL: postal address]]. For any question about your data, write to support@daguerra.com.

What we collect, and why

  • Order form (purchase page): your email, the offer, the amount, the transaction signature of your payment, your confirmation of the terms and your express consent to immediate delivery. Purpose: verify the payment, deliver your license key or file, keep proof of your consent, give support. Legal basis: performance of the contract, and legal obligations (accounting, proof of the withdrawal consent).
  • Order records: for each order we keep your email, the offer, the amount, the date, the transaction signature and the license key issued. Purpose: support, license management, accounting. Legal basis: contract and legal obligation.
  • Review form: your rating, your review text, your name, your email (kept private, to verify your license) and your consent. Purpose: publish your review on this site after we have read it. Legal basis: your consent, which you can withdraw at any time. If published, only the text, the name you gave and the rating appear.
  • Hosting logs: like any web server, the host keeps technical connection data (such as the IP address, the page requested, date and browser type). Purpose: deliver the site and keep it secure. Legal basis: our legitimate interest.
  • Emails: the messages you send us and our replies, including the email that delivers your license key. Purpose: support and delivery. Legal basis: contract, or legitimate interest.

This site uses Cloudflare Web Analytics to count page views and where visitors come from, in aggregate. It sets no cookie for this and stores no personal data: it does not keep your IP address in a form that identifies you, and it does not follow you from one site to another. That is why no consent banner is shown for it. The only cookie on this site remembers the language you choose (see the cookies page). We do not advertise, we do not profile you and we do not take automated decisions about you.

Payments

Payments are made in USDC on the public Solana blockchain. We receive no card or bank data. A blockchain transaction, including the sending wallet address, is public and cannot be erased by us or by anyone; we do not control it. We store the transaction signature you give us to match your payment to your order.

Your use of the Daguerra app

The app runs on your own RunPod pod. To check the license, your pod sends our license server (license.daguerra.com, hosted by Cloudflare) the license key, which contains the name and email of the order, a random id of the pod, its RunPod pod id and the app version, about once an hour; the server keeps the last time each pod was seen, to allow one pod per license. The images you generate are stored on your pod and are not uploaded to us. We therefore receive none of your prompts or images. Third-party services you connect yourself, such as RunPod, Civitai and Hugging Face, are governed by their own policies.

How long we keep it

  • Order records and payment proof: for the legal accounting retention period (10 years in France).
  • Form submissions held by our host: [[TO FILL: retention period of Netlify form submissions]].
  • Review submissions that are not published: [[TO FILL: retention period of unpublished reviews]]. Published reviews stay online until you ask for removal.
  • Support emails: [[TO FILL: retention period of support emails]].

Who processes your data

  • Netlify, Inc. (United States): hosts the website and stores the form submissions.
  • [[TO FILL: email provider used to send license keys and answer support]].

We do not sell your data. Data is shared only with these providers, with authorities when the law requires it, and with our accountant if we use one ([[TO FILL: accountant, or none]]).

Transfers outside the European Union

Netlify is based in the United States and may process data there. The safeguard used for this transfer is: [[TO FILL: transfer safeguard, for example the Standard Contractual Clauses of the host's data processing agreement, to be checked]]. The same applies to the email provider if it is outside the EU: [[TO FILL: email provider transfer safeguard]].

Your rights

You may ask for access to your data, correction, erasure, restriction, portability, and object to processing based on our legitimate interest. You may withdraw a consent at any time (for example a review) without affecting what was done before. In France you may also give instructions about your data after your death. Write to support@daguerra.com; we answer within one month. We may ask for proof of identity.

You may complain to the supervisory authority. In France this is the CNIL (Commission nationale de l'informatique et des libertés), 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, cnil.fr. You may also contact the authority of the EU country where you live.

Changes

We will update this page if our practices change and show the date at the top.
