Right of withdrawal and refunds

Your 14-day right of withdrawal

Under EU consumer law (Directive 2011/83/EU), a consumer may withdraw from a distance contract within 14 days without giving a reason. For digital content that is not supplied on a physical medium, the 14 days start on the day the contract is concluded.

Exception for digital content delivered at once

Daguerra licenses are digital content. The right of withdrawal is lost for digital content once its supply has begun, if you have first given your express consent to the supply starting before the end of the withdrawal period and acknowledged that you will lose your right of withdrawal (article 16(m) of the Directive; article L221-28 13° of the French Consumer Code).

That is why the order form has a required checkbox. When you tick it you ask for immediate delivery and accept that, once we have emailed you the license key or the file, you can no longer withdraw. Your consent is stored with your order. If you do not tick it, you cannot place the order.

If you withdraw before we have delivered the key or the file, we refund you and nothing is delivered.

How to withdraw

Tell us clearly that you withdraw, by email to support@daguerra.com or by post to [[TO FILL: postal address]]. You may use the model form below, but you do not have to. We will refund the amount paid, in USDC, to the address that sent the payment, within 14 days of learning of your decision. We cover the network fee of the refund.

Our refund policy, in addition to the law

You can also ask for a refund within 7 days of payment if the app does not run on a supported RunPod GPU and we cannot fix it after trying to help you. Write to us with the problem and a description or screenshot of the error. We will try to solve it first. If we cannot, we refund the amount you paid, in USDC, to the address that sent the payment. We cover the network fee of the refund.

This policy does not apply when the key has been shared or resold, or when the problem comes from your RunPod account, balance or token limits. It does not reduce your legal rights, including the legal guarantee of conformity. After a refund the license ends and you must stop using the app.
